ACO Regulations Just Released

The Centers for Medicare and Medicaid Services (CMS) has just released the long-awaited proposed regulations for Medicare Accountable Care Organizations. (CLICK HERE to view the regulations.)

CMS and the Office of Inspector General have also issued (CLICK HERE) proposed waivers for ACOs from the Stark Law, Anti-Kickback Statute, and Civil Monetary Penalties law.

The Federal Trade Commission and the Department of Justice have issued a separate statement (CLICK HERE) regarding antitrust enforcement policy for ACOs.

CMS’ ACO regulations address key issues such as criteria for federal approval, governance, assignment of Medicare beneficiaries, quality reporting, how shared savings are determined, and risk sharing models.

Interested parties have approximately 60 days to comment upon the proposed regulations.
